Terms of use of the Android<sup>TM<\/sup> application \u2013 \u201cEasy LeadSheet Viewer\u201d<\/h2>\n\n\n\n<p>With the installation of the application <strong>\u201cEasy LeadSheet Viewer\u201d <\/strong>(hereinafter referred to as \u201capp\u201d) on your device and\/or the use of the app, you fully accept these terms of use.<\/p>\n\n\n\n<p>If you do not agree to the terms of use, please do not use the app.<\/p>\n\n\n\n<p>The author of the app reserves the right to change the terms of use of the app at any time, in whole or in part, as part of the technical and functional development. You are therefore asked to consult the terms of use regularly.<\/p>\n\n\n\n<p>On relevant changes users will also get information through the app.<\/p>\n\n\n\n<p>Some basic terms that are referred to in the document are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201c<strong>App\u201d<\/strong>means the <strong>\u201cEasy LeadSheet Viewer\u201d <\/strong>software available for users in the Google Play Store for download onto their Android\u00ae devices.<\/li>\n\n\n\n<li>\u201c<strong>User\u201d<\/strong>means an individual who has downloaded and uses the App.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">1.1. Subject of the app<\/h2>\n\n\n\n<p>The purpose of the app is to create and manage simple, private, personal inventories on an Android\u00ae-based device.<\/p>\n\n\n\n<p>The app is provided \u201cAS IS\u201d with no warranties of specific functionality and without any express or implied warranties or conditions of any kind.<\/p>\n\n\n\n<p>The app may be updated from time to time to add new features or services or to adjust existing features and\/or services.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1.2. Technical preconditions<\/h2>\n\n\n\n<p>The technical preconditions that enable the installation and use of the app must be provided by the user. To access and use the app you will need:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A compatible mobile phone or a compatible mobile device<\/li>\n\n\n\n<li>Google Play<sup>\u00ae<\/sup> available on the end device<\/li>\n\n\n\n<li>A Google Play<sup>\u00ae<\/sup> customer account<\/li>\n<\/ul>\n\n\n\n<p>The following mobile devices are compatible:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Android<sup>\u00ae<\/sup> OS from version 9<\/li>\n<\/ul>\n\n\n\n<p>In case you want to use the Google-Drive<sup>\u00ae <\/sup>, OneDrive<sup>\u00ae <\/sup>, WebDAV, MyInventory Account integration for the backup function:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Internet access<\/li>\n\n\n\n<li>A Google<sup>\u00ae<\/sup>, OneDrive<sup>\u00ae<\/sup>, WebDAV or MyInventory account<\/li>\n\n\n\n<li>Sufficient storage space on your respective Google Drive<sup>\u00ae <\/sup>, OneDrive<sup>\u00ae <\/sup>, WebDAV,\u00a0 MyInventory Account<\/li>\n<\/ul>\n\n\n\n<p>The app can be downloaded free of charge from the \u201cGoogle Play Store\u201d.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1.3. Costs of use<\/h2>\n\n\n\n<p>The installation and use of the app is free for the user.<\/p>\n\n\n\n<p>However, this does not apply to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Any costs incurred through the use of the end device<\/li>\n\n\n\n<li>Any connection costs incurred as well as costs caused by the access to the Internet<\/li>\n\n\n\n<li>Any costs incurred for loading the app or saving your data over your online connection<\/li>\n\n\n\n<li>Any costs incurred for storing your data on your preferred online storage provider\u00a0<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">1.4. End user license agreement (EULA)<\/h2>\n\n\n\n<p>The user is granted a personal, non-exclusive, revocable, non-transferable, free right to use the app. This is granted exclusively for his own needs and within the scope of using the app for personal purposes to the exclusion of any other purpose.<\/p>\n\n\n\n<p>The user is not allowed to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Reverse engineering parts or the entire app<\/li>\n\n\n\n<li>Hack all or part of the app<\/li>\n<\/ul>\n\n\n\n<p>The terms of this license apply to any updates provided that replace and\/or supplement the original app, unless that update is accompanied by a separate license. In that case, the terms of that license will take precedence.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1.5. Rights, obligations of the user<\/h2>\n\n\n\n<p>It is the user\u2019s responsibility to take all appropriate measures to protect their own data and\/or the software stored on their devices (mobile phone, computer, etc.) against damage (in particular malfunction, viruses, hackers\u2026). By using the app, the user assumes responsibility for any negative consequences that may be caused by the app.<\/p>\n\n\n\n<p>The user expressly agrees:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To load the app onto their end devices solely for personal and non-commercial use<\/li>\n\n\n\n<li>Not to sell, rent, sub-license or otherwise distribute the App to third parties<\/li>\n\n\n\n<li>Maintain the Android device updated<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">1.6. Rights, obligations and liability of the author<\/h2>\n\n\n\n<p>The app is provided by the author \u201cAS IS\u201d with no promises of specific functionality and without any express or implied warranties or conditions of any kind. The author makes no representations or guarantees that the app will meet the user\u2019s specific requirements or be error-free. Access and use of the app is at the user\u2019s risk.<\/p>\n\n\n\n<p>The author is not obligated to provide technical support, maintenance, or updates for the app unless explicitly agreed upon under separate terms and conditions. The user is also responsible for ensuring that their use of the app complies with applicable laws and regulations, and for maintaining the confidentiality of any data stored in the app.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1.7. Required rights of the app<\/h2>\n\n\n\n<p>For the app to function optimally, the user must allow the following functions for the app under Android<sup>\u00ae<\/sup>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Camera<br>Used to take photos of inventory items and store them in the app.<\/li>\n\n\n\n<li>Access to the internal memory<br>Serves to save the data of the app on the end device.<\/li>\n\n\n\n<li>Access to the Internet<br>If you use the Google-Drive<sup>\u00ae<\/sup>, OneDrive<sup>\u00ae <\/sup>, WebDAV, MyInventory Account Integration to backup\/restore your inventory data on your respective account.<\/li>\n\n\n\n<li>Access to the status of the network<br>Used to check the network status before backing up\/restoring the inventory data and to warn you if there is no online connection. Optionally, the user can also be informed about a missing WiFi connection. Depending on your mobile phone contract, this can save connection costs.<\/li>\n\n\n\n<li>Microphone<br>Optional: If you use the function to create and add voice notes to articles. The application only asks for this right when you use the \u201cvoice notes\u201d functionality.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">1.8. Limitation of liability and disclaimer<\/h2>\n\n\n\n<p>The following is explicitly excluded from the liability of the author:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Direct or indirect damage of any kind resulting from the use or inability to use the app and in particular any financial loss and loss of data<\/li>\n\n\n\n<li>Direct and indirect damages of any kind resulting from the use or inability to use websites accessed with the app or with websites that the user accesses via the app<br>Note: the user can store addresses of websites in the data of inventory items and open them through the standard internet browser of the device<\/li>\n\n\n\n<li>Damages of any kind caused to the users, their devices, their computer and the data stored in them, or for possible repercussions on their personal, professional or commercial activities<\/li>\n\n\n\n<li>Damage of any kind, in case of improper use of the device and\/or an incident related to the use of the device when using the app.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">1.9. Scope of terms of service, geographical restriction and location<\/h2>\n\n\n\n<p>The Terms of Use apply to all users of the app. The use of the app is limited to countries in which Google Play<sup>\u00ae<\/sup> is officially offered by Google<sup>\u00ae<\/sup>.<\/p>\n\n\n\n<p>The app does not access the location of the end device.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1.10. Protection of personal data<\/h2>\n\n\n\n<p>Please read the detailed <a href=\"https:\/\/thomaskoslowsky.com\/en\/index.php\/easy-leadsheet-viewer-data-privacy\/\" data-type=\"page\" data-id=\"170\">data protection declaration<\/a>.<\/p>\n\n\n\n<p>The app does <strong>not <\/strong>send any data to the author of the app.<\/p>\n\n\n\n<p>If you want to use <strong>WebDAV<\/strong>, to backup your inventory data on your WebDAV drive, you have to log in to your WebDAV server account. Please check and agree on the terms of use and the data protection regulations of the WebDAV server provider before using it.<\/p>\n\n\n\n<p>You may not use the WebDAV integration if you do not agree to the terms of use and the privacy policy of the WebDAV server provider.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1.11. Technical restrictions<\/h2>\n\n\n\n<p>For the app to work optimally, certain functions of the mobile terminal must be activated (camera, access to the internal memory, access to the Internet, access to the network status).<\/p>\n\n\n\n<p>If these features are not enabled, blocked by the user, or not present on the user\u2019s terminal, some features of the app will not be usable.<\/p>\n\n\n\n<p>Due to the large number of different devices, different operating system versions and different software installed by the user, the compatibility of the app in all these combinations cannot be guaranteed by the author.<\/p>\n\n\n\n<p>The author cannot be held responsible for any malfunctions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1.12. Intellectual property<\/h2>\n\n\n\n<p>Downloading the app does not give the user any rights to the intellectual property rights of the app. This also applies to texts, graphics, symbols, logos, trademarks used in the app and in general to all elements that make up the app.<\/p>\n\n\n\n<p>The app uses graphics from OpenClipart.org, standard Material Design Icons for the Android platform and images generated by AI.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1.13. Termination<\/h2>\n\n\n\n<p>Both Google and the author can decide at any time to stop providing the app.<\/p>\n\n\n\n<p>The decision to stop providing the app does not require any justification and in that case, there is no right to any compensation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1.14. Action, jurisdiction, and governing law in dispute<\/h2>\n\n\n\n<p>For the form, effectiveness and validity of these Terms of Use, the laws of the author\u2019s domicile (Barcelona, Spain) apply.<\/p>\n\n\n\n<p>Before taking legal action, the parties undertake to try together and in good faith to find an amicable solution. Any complaint will therefore first be addressed in writing to the author.<\/p>\n\n\n\n<p>Any dispute that may arise from the validity of these Terms of Use, their interpretation or their implementation shall be exclusively brought before the courts located in Barcelona, Spain.
